I’m trying to find the proper phrasing for a sign warning event attendees that there will be filming going on and that they may be caught on video through the course of the day. Obviously I’m not talking about interviews where I’ll have them sign a release.
Something like “Attention: Live filming will be taking place during this event. You may be captured on video.”
I have often seen wording on the ticket stub to the effect that, “by attending this event you give consent for your image to be used in any way deemed appropriate by the management.”
That’s very broad, and might not be enforceable if not brought tothe attention of the attendee before the attendee bought the ticket. In addition, if I buy two tickets, and bring along a friend as a guest, it might not be enforceable against the guest: no consideration, no contract, and inadequate notice.
In my state, Virginia, you have to notify people if you record their voices, but not to photograph them in public places.
The most common wording I have seen says, “Sound and video recording is being conducted in all parts of this facility.” No mention is made of permission.
