A while back, we moved to dismiss a case against one of our clients. Yesterday, we received the order denying the motion to dismiss.
Because the issues were somewhat unusual, the judge relied on a District of Maryland case in denying our motion (we are in Florida), even though neither party had cited to the Maryland case in their briefs. The Maryland case was another case involving some of the same issues, in which the court also denied a motion to dismiss.
As it happens, the plaintiff in that case was represented by my old firm, and I’m the one who wrote the successful opposition to the motion to dismiss. So, if I hadn’t done such a good job in that case, my current client might have had the case against them dismissed.
Well, it gave me a giggle.
