I think there’s a difference between genuine questioning of an opinion and rejecting the opinion, especially after the opinion was explicitly sought (“Seven votes for Bush, Jr. Anyone care to say why?”).

I don’t think there was any foul. A claim was made for Bush, I debated the points made in his favor, some discussion was created back and forth, the Bush supporter mounted a spirited but civil defense, and as far as I can tell no feelings were hurt.

Here is an article (pdf) describing the history of FISA and the subsequent “Wall” and its effects on investigations.

For example two of the 9-11 hijackers who had been identified as possible jihadists were living with an FBI informant. Because of the wall between intelligence and enforcement the intelligence agencies did not know about the informant and the FBI did not know about the hijackers. Also one of the hijackers had been involved in the Cole bombing and the FBI Bin Laden task force learned he was in the US in August 2001 but the wall prevented the task force from using criminal investigation resources from trying to find him.

The great thing about being President is that you’re above the top of all of those walls. You’re getting all these warnings from the CIA, so you can have your Cabinet send the word down that anyone in their agencies that knows anything that might seem relevant should pass it on up.

This was the Clinton/Gore approach with respect to the Millennium bombing plot. To what extent it made a difference in that case is debatable, but ISTM that it would have been exactly the right approach to the repeated warnings about a potential al-Qaeda attack in the U.S.
