But there’s still time for him to force Obama to implement all of Obamacare in 2014.

Of course, Boehner’s simply hoping people will forget about his promise for this suit, the way he hopes they forget about his promise of a Republican replacement bill.

In his op-ed, Boenher says:

If it’s legislation, it can’t pass without the Senate’s approval, and the President can veto it, and no way is there a 2/3 majority in both houses for such a thing, nor will there be after the midterms. The suit will never be filed if it takes legislation to authorize it. Boehner must know all this.

It’s an election year and they need some red meat to get the base riled up.

Then, as now, it is utterly hilarious that in the whole of Boehner’s op-ed for CNN, he could only muster one specific claim about anything Obama had done that was unconstitutional, something that the Supreme Court had already decided.

To be fair, Obama wanted to close Gitmo and Congress used the power of the purse strings to keep it open. It’s not like he has a choice in the matter.

I wonder how anyone can even think about making that comparison. I mean, do you really think being stopped from doing something by another group, is the same as someone not doing something they’re free to do?

Apparently the problem is, Boehner can’t find a lawyer who will take the case.

Well, they finally filed the lawsuit.

The suit accuses the administration of acting without congressional authority in delaying the employer mandate provision of the Affordable Care Act. It also challenges the administration’s giveaway of $175 billion to insurance companies under the law because the funds weren’t explicitly appropriated by Congress.

The move comes just hours after the president announced that he was taking executive action to shield millions of undocumented immigrants from deportation, a step that Republicans also deem worthy of legal recourse because of his decision to bypass Congress. The GOP lawsuit does not, however, include immigration.
