World Trade Center landlord sues Cantor Fitzgerald for rent prior to Sept. 11

Who do you think will win this lawsuit?

It’s a simple breach of contract suit, and were it not related to 9/11 it wouldn’t rate a mention. If CF owes the rent then CF should pay it. If CF won’t pay it then CF should lose the suit.

Seems perfectly reasonable to me. CF clearly owes the debt.

From what I heard on the radio, everyone else has paid already.
The landlord owes the money to the Port Authority, so it isn’t like he is making a bundle on it.

I think with all the hardship Cantor Fitzgerald has gone through…

They owe rent. Rent should be paid.

Same here. The only way this would be objectionable would be if the landlord tried to collect for ANYTHING 9/11 and forward.

I’m just surprised it took a year and a half to get a lawsuit filed.

It’s not for lack of trying. IIRC, he tried to argue, unsucessfully, that since 2 planes attacked 2 different buildings, he could file 2 claims and get 2x the settlement. The courts denied his attempt and ruled in favor of the insurance companies, that it was considered 1 act. I may be a little confused, so I will try to find a link.

However, it does appear CF owes, and should pay, the rent up until Sept 11.

If they had crashed the second jet into another building (like the Millenium Hilton), would it have been treated as another event?

The Millenium Hilton was not part of the WTC Complex, was it? It appears that the court is considering the North Tower and South Tower, while seperate structures, to collectively be the World Trade Center. One building.
