Man Ticketed En Route to Hospital

NEW ORLEANS (AP) - Sheriff’s authorities are investigating a deputy who allegedly held up a hospital-bound heart attack victim for 30 minutes while issuing a traffic ticket.

Benjamin Basile, 50, of Kenner remained in stable condition Saturday after spending a week in intensive care. From his hospital bed, he said last weekend’s traffic stop made him ``mad as hell.’’

Jefferson Parish Sheriff Harry Lee decided to investigate Deputy Bryan McClendon after the family filed an internal affairs complaint this week, said department spokesman Bob Garner.

McClendon mocked the family and even threatened to arrest Basile while he and family members begged the officer to let them proceed, Basile said.

He was being driven to the hospital by a nephew. ** His mother, Gladys, also was in the vehicle. ** The nephew accidentally ran a red light moments before McClendon pulled them over, Gladys Basile said.

When Benjamin Basile tried to get out of the car to talk to the officer, the deputy slammed the door on him, family members said.

** ``He kept yelling at me, ‘You want to go to jail? You want to go to jail?’’’ Basile said. **

According to Basile’s family members, when McClendon finally issued the ticket, he said: ** ``Y’all go ahead and have your heart attack or stroke now. Have a good day.’’ **

Garner said the sheriff’s office will determine if McClendon, a nine-year veteran of the force, did anything wrong.

Here’s what should have happened…

Guy runs a red light. Cop pulls him over (as he should - he has no way of knowing there’s a medical reason.) Guy explains his uncle’s in the backseat having a heart attack and they’re rushing to the hospital. Cop gives family an escort to the emergency room where he’s then able to write a ticket to the nephew after the uncle’s been dropped off at admitting.

How hard could that have been to figure out? I hope he pays dearly for what he did to that family.

I agree that the guy should be disciplined in some way. However, I am not sure if the family would have a good case for the courts. If the poor guy had died, then they would have had a good case and probably could have received millions from the officer, not to mention that the officer could have been charged with some sort of crime (criminal neglect? Reckless endangerment? I’m not sure what charges could apply). I’m sure the family will try to sue, but whether they would win is another matter.

But, I agree, this officer must have left his brain at the doughnut shop that day. Sheesh!

I would think that any delay when someone is having a heart attack, any delay would be potentially fatal, especially one of 30 minutes. The deputy should lose his job, a shitload of money, and get shot in the leg. Can anyone back me up on this?

Not arguing here; the cop was so far wrong it’s a crying shame. And even (fortunately! the man didn’t die, the family should have a case just based on civil expectations.

But cops are in that category of folks who have to perform perfectly, first time out, no excuses. This guy blew it, big time. In my experience, cops are the good guys. They genuinely do protect and serve. I just wonder what the hell was going on in his command that they didn’t see a burnout case. They should have gotten him off the street and into some help.

Even though the family probably panicked and were less than polite/coherent, the cop was there to help citizens in need. It’s sad that one person’s lack will give good cops everywhere a little tougher road to walk. Cops take an incredible amount of abuse, and deal with dysfunctional lives out of control. Sounds like this guy is either unsuited to police work or has burned out and needs remedial action.

BTW, damn straight he should have radioed ahead and provided escort. What a pisser, all the way around.
