Not necessarily, by any means. Plea bargains are often negotiated after suppression motions are heard and decided. These motions are usually “in limine” meaning they are aruged before the trial itself gets underway. A defendant that has a chance to win outright if his suppression motion is granted usually wants to wait until that outcome before agreeing to a plea.

And even if not – there are pleas that are reached conditional upon the right of the accused to appeal the decision solely on the suppression motion. That is, the guy will say, “I plead guilty, as long as we agree that I still have the right to appeal the illegal search.” He thus gives up his right to a trial, but retains the right to get an appellate court to take a second look at the search.

And yet that rat bastard Bush hasn’t called me ONCE.
