Not have sex with a drunk young thing who is a stranger to you? Only have sex with people after you get to know them? Hold off on sex if your partner is really drunk, especially if you’ve never met him or her before?
I’m failing to see the hardship here in expecting adults to be responsible for knowing who they’re having sex with.
So maybe sometimes an adult has to exercise adult judgement and pass up on sex if they’re not really sure if the drunk stranger they just met is lying or not. I call that, “Smart Thinking”.
I’m not in favor of making the world safe for adults to have sex with minors. If that means grown ups will get in trouble if they fail to display grown up judge decision making, well, I don’t have a problem with that.
It would seem to me that this is a perfect case for jury nullification. If the jury believes that a conviction would be contrary to justice even if it follows the letter of the law they can nullify that law as applied in that case.
Their was a 12 year old girl in my sons 6th grade class who was about 5,10 and looked MUCH older. Her mother said she often got hit on by young men thinking she was 16.
I don’t think using discretion in who you sleep with requires you be a mind reader. If someone looks young maybe not fuck them within hours of meeting them.
I don’t see ‘I didn’t know they were 12’ as a valid defense.
If a 12y/o can trick you into bed it’s probably safer for everyone if you’re locked up.
So does the UK have a similar concept as double jeopardy? I ask because I know in some countries, like Italy, the government can appeal a not guilty verdict.
Everybody involved, including police officers who were specifically searching for minors, were fooled and assumed she was up to 20 yo. So, she “tricked” everybody, and there’s no doubt she looked, and even acted, vastly older than her age.
She presumably still looked “young”, like in 17-20, but that was the age range of the guy too. Was he supposed to only hit on women looking 30 yo and more?
Honestly, given that the person in question clearly lied about her age in order to get what she wanted, I wonder if the term “victim” can even apply here. It’s like being the “victim” of someone selling you pot - you’re not a victim, you wanted to buy it.

Well, I believe they do BUT in this case it was not a “not guilty” verdict, the young man was convicted, and in sentencing the court took circumstances into consideration to order discharge rather than further imprisonment and reporting.
