It was a pretty big invasion. So it’s conceivable Spiderman and other heroes were fighting the Chitauri but in another part of Manhattan.
The more difficult question is why we didn’t see Jim Rhodes during the battle. We know at this time he was using a second Iron Man suit. You’d think Shield and the Avengers would have been happy to have two Iron Men during the fight.
So say we all.
Yeah, NYC is superhero central, but even in the comics they don’t all show up for epic battles unless it’s a big cross-over event. I always assume they’re currently off on different missions.
By an odd coincidence, it was in the AIM paint shop undergoing the Iron Patriot makeover when the invasion started. By the time it dried, they’d already nuked the Chitauri.
They kinda established in Iron Man 3 that
The Iron Patriot is stuck with babysitting the President & Vice President.
