How much did Dassey’s confession contribute towards Avery’s conviction? It’s been a while since I watched the series.
I don’t believe Dassey’s confession was presented. Dassey certainly didn’t testify.
From that article:
I’m not sure how accurate that is, but if it is accurate, this could help Avery.
is he (Dassey) out yet?
Dassey still in prison, Supreme Court turned down his appeal today
I’d love to know their reasons for denying the appeal, but apparently by custom they don’t reveal their reasons for such denials.
The portions of his interviews shown on MAM make it appear, at least to me, that his confession was coerced.
If I was on a jury and was shown what we saw on TV I certainly would have reasonable doubt.
I suppose it’s conceivable that what we saw on TV was edited to give a false impression.
The Supreme Court only acts on misapplication of the law; not on the possible innocence of any defendant.
Also, MoaM wasn’t an objective telling of the facts.
I’m not really surprised that the SC didn’t take the case. They would be looking at legal and constitutional issues. I am dismayed, however, that the local courts didn’t grant a new trial or overturn the conviction. It seems to me it was a miscarriage of justice to convict the boy, given how he was interviewed. But the blame goes to his mother, who allowed the interviews without a lawyer present.
True, but the videos are pretty compelling in showing the boy being manipulated by the police. As indicated in other threads here, the boy would have been much better served by clamming up and simply asking for a lawyer. Or, given that he was under 18 at the time, his mother should have denied any interviews without a lawyer.
I don’t disagree with the police manipulation, but that SOP in interviews. They are also permitted to lie. The best his defense team can hope for is new evidence to emerge.
I agree. I think legally allowing police to lie to people/suspects they are interviewing shouldn’t be permitted. But it is, unfortunately.
I think the argument is that he was intellectually challenged, and not able to know or understand what the police were doing, nor understand his rights. I have to admit that even that argument falls apart when his mother allowed the interviews without a lawyer present.
It’s been some time since I saw the TV show. Were the police interviews shown to the jury to the extent we saw them?
a judge did give him a new trial but then that ruling was reversed. The SC turned him down which means they did not have an issue with that reversal.
He could still appeal on other grounds if he can find another reason to appeal and find lawyers to help .
I watched Season 2 thinking that I had already seen the first one. Then I realised that I was confusing the first season with a Dateline or something like that I had seen.
So then I watched the first season.
… all of the above is just a shameless way to bump this thread.
