I’m not talking about a dispute with the landlord or self defense or anything like that…more along the lines of some random schmoe comes up off the street and starts camping out on my porch or something. Do I have the legal authority to tell him to buzz off or call the police, or do I have to go through the landlord, legally?
As a renter, you have what’s called a “leasehold” (and it doesn’t matter if you have a written lease or a handshake agreement to pay by the week or whatever, that’s what it’s called). It means that in consideration of rent money paid to the landlord, you have the right to use the property, subject to reasonable limitations, “as if it were your own” – in the sense of exclusive occupancy of a house/trailer parcel, shared exclusive occupancy of an apartment structure and exclusive use of your own apartment, without of course the right to make permanent changes without landlord consent, etc.
You can evict a trespasser, obtain police assistance in doing so, etc. It’s a courtesy to let your landlord know about it – it is, after all, his property as far as fee simple title goes – but there’s not even a legal obligation to do that unless it’s spelled out in either statute law or your lease documents.
IANAL, but this is actually generally true, isn’t it? The landlord gives up the right to possess or occupy the premises as part of the lease agreement. Of course, this doesn’t apply if the landlord enters the premises to make repairs, or to collect rent.
Since the porch guy is legally tresspassing, I think the police would tell him to go and if he refused, take him in. They could always charge him with interfering with a police officer.
