Bank robber with cold feet. Should he be charged anyway?

Dude. On the one hand, I greatly respect your legal knowledge and ability to explain it to the layperson. On the other hand, I am in awe of your boilerplate. :stuck_out_tongue:

I suddenly had the mental picture of me walking into my bank wearing a fake beard, dark sunglasses, a hat and a blazer. Then calmly going up to the clerk and making a withdrawal from my account. I’m female by the way.

This is very funny to me. But somehow I think it would be less funny to the clerk.

Oh, yeah, regarding the actual topic of the thread, I think he should be charged with attempted robbery. He attempted - then he chickened out. If he had chickened out at home, it wouldn’t have been an attempt.

Bricker, while I tag this onto a joke, to appear less fawning, I really appreciate your explanations.

I’m sure that it must be frustrating at times to put up with various BS from the ignorant masses, and other lawyers have given up, please continue to enlighten us.

Heh. The image of that is hilarious to me too, but I seriously don’t recommend it. Back in his bachelor days, my S.O. walked into a bank to cash a paycheck wearing his usual attire of a long black trench coat, an army surplus hat and carrying a mandolin in a case. The security guys actually drew on him and made him open it.

Just because they bottled it THIS time doesn’t mean that they’ll chicken out of the robbery the next time and being panicy they are more likely to kill or hurt someone during the course of the next attempt

British police usually when they have prior knowledge of a bank robbery do nothing to discourage it but lie in wait and shoot dead the robbers as soon as they produce their weapons.

They deny this of course but I think its a good policy myself though the lawyers dip out financially poor souls.

Reference stealing from shops ,the U.K. practice is to only apprehend thieves who have actually left the shop without paying.

Oh god, someone’s been oiling up his cigar cutter again.

It seems that jtgain has fled this thread, though. A pity.

Huh. Maybe I should re-evaluate what I sometimes do when I go into a store for one item and find others that I want or need. Not having had the foresight to bring a basket, I sometimes stuff the items into a pocket and produce same at the check out.

I also realize something else from this: what if I forget an item and leave it in my pocket and walk out of the store? I think that my method is probably a bad habit to get in to. :o

i usually eat and drink stuff in the store before i pay for them. sometimes i even end up paying for an empty packet by the time i reach the counter. no one ever stopped me. how does this compare to putting them in your pocket?

IANAL, IANYL, IDNPALOTV* so let’s get anyone worked up on my WAG.

I also sometimes do this, but I’m guessing that if you keep the wrapper out visible and it doesn’t look like you’re trying to conceal it, many stores may not care so much about it. Most of the food that you would tend to eat while in the store isn’t that expensive, anyway, so I guess that the stores aren’t going to make as much of a fuss over a $1 candy bar vs. slipping $100 merchandise into your pocket.
