There is a difference between brewing temperature and serving temperature.
The reason that McDonald’s was held liable in this case was because the had their equipment way out of spec, with the rationale that they would sell more coffee if they served it hot enough that take-away customers would find that it was still piping hot after they arrived at the office. To do this, they served it at a significantly hotter temperature than it was served anywhere else. If you recall, it was served so hot at McDonalds that it was actually too hot to consume on premises; you had to wait until it had cooled considerably, or scald your tongue.
Serving temperatures are much lower than brewing temperatures.
For this reason, when a Denny’s waitress dumped most most of a pot of fresh coffee in my lap when I was a teenager, it ruined my night and the area was red and tender for a couple of days – however, I did not require reconstructive surgery on my genitals, even though I carelessly keep them outside of my body.
