You do understand that would then earn you a nice murder charge. “I still feel he’s a threat” justifies hitting him hard more than once. “I want to inflict maximum pain before killing” justifies taking you away.

Could be. They probably think this is not a case to throw the book at but they do have to complete some formal steps, they can’t just shake his hand, say “attaboy”! and apologize for having to confiscate the tire iron.

Yes - it’s an expression. It flows better than detached reflection isn’t required when you are confronted and attacked by your wife’s rapist who is escaping after breaking into your home.

OK, my bullshit sense is tingling.

She is being assaulted by a man who broken through the door and beat her with a chair, but she has time to make a phone call. And she calls her husband, not the cops.

He rushes home just in time to find the perp in the hallway. Then he plays whack-a-mole on his noggin.

Assuming all is as reported (a big assumption), as a member of the jury, I would have no problem acquitting. Me? Myself? Yes, I could see that happening.

Other sources say Diallo was outside the building, possibly already looking for a parking spot.

It doesn’t say she didn’t call the police as well, and in any case she could be sure that her husband would get there as soon as he possibly could. As a Lyft driver, she knew he could probably get there pretty fast.

It’s unfortunately likely that the cops might not be quite so quick to respond to an assault call in a low-income black/Latino neighborhood.

She might reasonably have expected a much faster response from her husband than the cops.

The article says her sister was there with her and helped her fight him off, so maybe she was able to call at that point.

Clearly he was committed to his career as a criminal. Why, allegedly he even clearly announced what were his intentions!

If it happened as reported then I don’t see it getting past a Grand Jury. It may not even get that far.

However what can’t happen is that someone dies and investigators immediately take the suspect at his word and let him go. This was handled properly. He should have been arrested and if the investigation shows he did act properly the charges should be dropped. But there are a lot of questions to be answered first.

He could’ve double-parked. But that’s against the law.

If this had happened in a wealthy white neighborhood, Mr. [del]Diallo[/del] Plimpton-Smythe would never have been arrested in the first place. At best, they might have done a token presentation to a grand jury. The ACLU should be all over this. :mad:

Totally. He should have legally parked his vehicle, did a 360 degree walk around to make sure he was properly parked, then proceeded to walk at a safe speed and offer the rapist a cup of tea before smashing his skull with a tire iron.

One of the articles in Bone’s links says she was able to grab her cell phone, and the first number that came up was her husband’s, so she called him and told him to call the cops.

Exactly. “The reason I killed the guy is because he was raping my wife” is not a statement that should be automatically taken at face value. I’m not saying I believe it’s false in this case, mind you, just that it ought to be subjected to a proper investigation.
