CA Attorneys - Case law on AB489?

Have any cases been brought under this law (predatory lending)?

If so, how may I find them?

Thanks!

This is not legal advice.

Check with a local California attorney for proper legal advice.

I believe AB489 was added to the provision of the California Financial Code. It had provisions covering more than one section, but I believe the section you would most be interested in is Section 4973, which is entitled Prohibited Acts.

What you are looking for is something called the California Financial Code Annotated. The annotated parts means that a legal service has put any case law involving that section into the compendium of the statute. Now, seeing as how most legal services don’t like to do a ton of work for no pay, I was not able to find the Code Annotated online for free. You would need to subscribe to Lexis or Westlaw to find it online. Or, you could buy it for $150. Or you can go to a local law school and look for the California Financial Code Annotated. It should list any caselaw involving that statute. FWIW, I could only find cases that dealt with the issue of how the statute worked in conjunction with local ordinances dealing with the same issue.

Like I said, consult an attorney in California. He’ll be way more help than I can be.

Thanks!
