Having a camera in a place where it could be reasonably expected to have a naked child in a private rental unit seems to cross that line. The surveillance for thief aspect doesn’t seem to be justification for this, and quite frankly sounds more like a excuse to gather nude photos and video (not necessarily kids photos, but nude photos).
The camera was mentioned in the contract, wasn’t hidden on the wall, and was in the living room, not a bedroom or bathroom.
And in a are where kids can be expected to be disrobed. Don’t think you can sign that away.
It was in the middle (not like its own section or anything), but that said, it’s not like an itunes agreement or anything, so a reasonable reading of it would have pulled it out. I just had never thought to look for this.
Which I assure is the category this fell into!
Living room but pointed toward the bathroom; not that this was nefarious, just that it was the place to point the camera that would cover most of the room. But the bathroom is the size of a postage stamp, and not attached to a bedroom. So, anyone with little kids will tell you there is precisely zero chance that after bath time they are not going to parade naked into the bedroom.
I ended up not saying anything. They reviewed me well on the site, so I assume I gave them no reason to review the footage. But, frankly, it is a little concerning because I have no way of knowing that, and I know for a fact now that there is footage of my kids that at least did exist. I have to trust people I never met to do what they said that they would do.
