I forget the rules. I thought it didn’t count if the state kills him. Besides, they ain’t gonna ace him this year. The gear of justice don’t grind that fast.

AIUI, if he were to be executed this year, it would count, since he was not under the Death Penalty during picks.
The closest turn-around I can think of off the top of my head is Tim McVeigh, who was executed 4 years after conviction.
I’m sure there’s shorter periods (especially in the Old West - if pop culture is to be believed - or during times of war for acts of treason), but I can’t recall any without research.
State sanctioned executions are not eligible under any conditions.
Then I understood it incorrectly. Root still isn’t a bad pick for next year, I think the chances of him surviving to his execution date are slimmer than most.
Do you think someone in prison will whack him? Jeffrey Dahmer was beaten to death as I recall.
