Change to Monthly Parking Fee

If I have a signed agreement with a parking structure in Milwaukee, WI to pay $110/month, what kind of notice do they have to give me to raise the fee?

Relevant bits would be: “The Montly Parking fee is $110.00, payable before the first (1st) day of the month,” and “This agreement is automatically renewed at the end of every month unless either party gives the other written notice of intent to terminate.” There is no discussion of what happens if the fee changes.

Allegedly there were signs posted (none of our parkers are in the office today for me to ask), but there were no phone calls, faxes, or letters to the office informing us of the change.

The law in California for that (I’m not a lawyer, but I know) is that the notice must be the same period as the payments. If you rent by the week they must give a week’s notice, if by the year, then a year’s notice. On any auto renewing contract. In effect, if they had yearly payments and wanted a shorter period, they would have to use their terminate clause and let everyone off, or get them all to sign a waver, but they can’t demand the contract remain and the terms change in less than the payment period. I would think signs do not count as notice, since you are under no obligation to park there every month you pay.
