Civil Trial: Trump v E. Jean Carroll (Carroll wins, awarded $5 million, plus 83.3 million)

My eyes have crossed!

I didn’t know then, but now I know what I wish I knew, Y’know.

FWIW, I’m following the trial as reported on MSNBC most of the day. Judge Kaplan is apparently smacking down Trump and his attorneys regularly. I had heard he’s a real hardass and puts up with zero nonsense. “I make the rulings in this court, not the attorneys. Sit down.” That kind of stuff.

They’re reporting now that he’s now telling Trump if he can’t control himself (making loud comments, slapping the table), he’ll be removed.

Anyway, I for one am getting vicarious pleasure in hearing it.

Sadly, Judge Kaplan can’t have a sit down with Judge Hoffman to discuss Bobby Seale and the proper way to deal with obstreperous defendants.

Endless demonstrations of his absolute and total lack of impulse control has to inure to his immeasurable benefit when the subject is sexual assault.

Our firm had a very unpleasant experience in his court. I’m glad the Trump team has to put up with him.

Yeah, that nuance wasn’t lost on the legal experts providing analysis. It does NOT help his cause and makes Carroll’s testimony that much more credible.

Seale was not being an ass. Big difference!

Seale was not . . . orange. Big difference!

Or he could just watch Bananas

That’s been the whole point of his performance. He wants to paint him self as a perpetual victim of the mean biased court system. His MAGA’ts are being told that he’s a poor, poor baby who is being attacked personally by Biden. Trump’s court performance is designed to further this nararative.

I doubt that. It would require some thought, which Trump doesn’t do.

One of the experts basically said that, that this must be a political strategy because as a legal strategy, it’s horrendous.

$5.5 million (111 percent of the judgment, as is required for this) has been put in escrow until all appeals have been exhausted.

trump has habba arguing this case. from the reporting ms habba is channeling her inner trump.

first she stated:

Attorney Alina Habba said, “I don’t know how to try this case, Your Honor.”.

To which the judge said, “I have heard you. I have considered what you have to say, and I have ruled. That’s it in my courtroom. When the ruling is made, that is the end, not the beginning of argument.”

she keeps trying to delay the trial for mother in law’s funeral. judge reprimands her:

“I will hear no more argument on it,” Kaplan said. “None. Do you understand that word? Sit down.”

Habba fired back.

“I don’t like being spoken to that way,” she said. “I’m not going to speak to you that way. I am asking for an adjournment for a funeral.”

“All right. It’s denied,” the judge responded. “Sit down.”

at the lunch break trump was reprimanded for commenting:

Throughout Carroll’s testimony, Trump maintained a stream of commentary and reactions from his place at the defense table.

During a break in which the jury was excluded, Carroll’s attorneys told the judge that if they could hear Trump’s comments, it was likely the jury could as well. When the trial resumed, Kaplan asked that the former president “take special care to keep his voice down when he’s conferring with counsel so that the jury does not overhear it.”

Trump clearly didn’t get the message, because shortly after Kaplan threatened to have him [outright removed].

“Mr. Trump has the right to be present here, but that right can be forfeited and it can be forfeited if he is disruptive and if he disregards court orders,” Kaplan said. “I understand you are very eager for
me to do that, I know you would because you just can’t control yourself in this circumstance.”

I’m former AZ Governor, Jan Brewer, and I approve this message:

Again, it’s performance art. It’s designed to cement “poor, poor victim Trump” status into the minds of the MAGAts.

I agree, but he’s going to cement himself into $50M in punitive damages.

This quote makes a bit more sense in context. From CNN:

Kaplan responded, “Mr. Trump has the right to be present here. That right can be forfeited and it can be forfeited if he is disruptive, which what has been reported to me consists of. And if he disregards court orders, Mr. Trump, I hope I don’t have to consider excluding you from the trial.”

Trump threw his hands up in response.

“I understand you’re probably eager for me to do that,” Kaplan said.

Reporters in the courtroom heard Trump say, “I would love it.”

“I know you would,” Kaplan said. “You just can’t control yourself in this circumstance apparently.

trump attorney has just asked that the judge recuse himself for “general hostility” the judge denies the request.
