Civil Trial: Trump v E. Jean Carroll (Carroll wins, awarded $5 million, plus 83.3 million)

habba wants to ask trump three questions on the stand. right now the judge is questioning habba on what she is expecting to have trump testify. trump keeps interrupting and interjecting.

the judge admonished trump for interrupting and interjecting.

the judge is stating that there will be no open ended questions.

habba is stating that she will ask if he stands by his depositon, if he intended to hurt ms carroll with his tweets.

trump is now being sworn in.

This sounds like the setup to a punchline.

CNN says he’s been and done. Trump took and has left the stand.

i missed the third question due to an incoming call.

the judge doesn’t have a buzzer, but he does have a white noise thing.

whoa, he took the stand and is off the stand and court is done for the day.

the judge did have part of trump’s answer stricken. ms carroll’s team asked just a few questions.

the expectation is that the jury will have the case early afternoon tomorrow.

Thank you @rocking_chair !

Has the prosecution indicated whether they intend to cross examine Trump?

Trump attorney Alina Habba questioned Trump about his 2019 comments responding to E. Jean Carroll’s sexual assault allegations, asking if he viewed he allegation as false.

“Yes I did," Trump said. “She said something that I considered a false accusation — totally false.”

Judge Lewis Kaplan, however, cut Trump off, saying: “Everything after ‘yes I did’ is stricken.”

When asked if he said the statements to hurt E. Jean Carroll, former President Donald Trump said “No, I just wanted to defend myself, my family and frankly the presidency.”

Nitpick, Plaintiff’s lawyer, not prosecutor, since it’s a civil trial.

And it appears they don’t wish to. I guess they have what they wanted from the deposition.

Ah, dumb error on my part. Thanks for the correction.

the judge put very strict lines on what trump could say or be questioned on. ms carroll’s team really couldn’t ask much.

My source (Harry Litman) has the opposite response:

As you noted, other sources have him saying “no”. We will see…

interesting.

now that the reporters are out of the courtroom, a few more details are being reported out.

ms carroll’s team showed video of trump’s deposition regarding his worth, asking if he stood by his statement; they also showed video of him confusing ms carroll with ms maples.

it appears that carroll’s team was showing that ms carroll was his “type”, and showing the jury that they could really go high in the punitive damages.

dealing with trump must be like dealing with a “sovereign citizen” in the court room.

Her lawyers played a clip of Trump’s video deposition that he sat for last year, ahead of his bank fraud trial in New York. In the clip, Trump brags that his Doral resort in Miami “could be worth $2.5 billion by itself.” In another clip, Trump claims that his value has only increased since becoming president. “Probably my most valuable asset … that’s the brand,” he said. “I became president because of the brand. I think it’s the hottest brand in the world.”

“I did an NFT deal the other day.… It sold out in less than a day,” he added, referring to some truly wild digital art of himself that he sold in late 2022.

Sometimes he is his own worst enemy.

Wrong link, I think.

Yeah, it is there on the New republic, but after I went there, they had moved on.

trump continues to be uncouth. he arrives late and leaves during team carroll’s closing statement.

the judge has threatened habba with contempt and time in the pokey.

from cnn:
Former President Donald Trump left the courtroom shortly after E. Jean Carroll’s attorney Roberta Kaplan began delivering her closing argument in the defamation trial.

It’s not clear why Trump left the courtroom.

When Trump walked out, Kaplan was in the middle of telling the jury that Trump did not respect the prior jury verdict. “Not even for 24 hours,” she said.

After Trump left, Judge Lewis Kaplan — who is not related to the attorney — briefly interrupted Roberta Kaplan to say, “The record will reflect that Mr. Trump just rose and walked out of the courtroom.”

The judge then admonished the defense, again telling them they must remain seated. He specifically said that includes Boris Epshteyn, who walked out with Trump and just returned to the courtroom without him.

and:

Trump attorney Alina Habba then tried to make a record to refute a ruling that the defense cannot use a slide they planned in their closing presentation. Kaplan just cut her off and said: “You are on the verge of spending some time in the lock up, now sit down.

I’m not sure how it works in a civil case courtroom, but it’s my understanding that in some courts, if someone else were to pull this stunt (standing up in the middle of proceedings and walking out) they’d be hauled back by the bailiff and the judge would either admonish them or find them in direct contempt then and there and send them off to the jail to think about it for a day or seven.

It always portends a great outcome for the defendant when the antics of their lawyers infuriates the judge!

i’ m figuring on any judge who will have trump in their court room has taken note of this behaviour and hopefully will slam dunk him.

i am a bit surprized that the judge didn’t hit trump with a fine or something for the walk out in front of the jury today.

he has walked back in, per cnn:

Former President Donald Trump — who walked out of the courtroom early during E. Jean Carroll’s attorney’s presentation this morning — has returned to the defense table.

Trump attorney Alina Habba has begun delivering her closing argument.
