Isn’t all this proving Hur’s point? Like not being able to remember when a significant event happened (even though you knew the year at one point), Biden similarly likely would not have remembered having classified info (a significant thing) even though he knew he had it at one moment in time (because he talked to the ghostwriter about it). He later forgot about having it. Knowing that he was keeping classified info is an element of the crime, but it was not met here for this reason. Biden forgot about it.

I think Schiff had it right, it was more the gratuitous summarizing/generalizing (elderly man with a poor memory) of those couple of instances of not being able to remember significant events with accuracy that was the real issue re: memory/lack of not meeting willful element.
And all the rest. I’m just focusing on the willful element/poor memory part implying it’s normal not to remember significant events. Which I agree with. Which I’m the same with re: my Dad. 2006?

I’ve come to believe it’s such an awful grievous thing that unlike a birthday(good thing) it pains you to the point of causing disbelief. Maybe part of the denial stage in grief. My 2 cents.
Biden is old. He bound to have some lapses in memory. Doesn’t mean he’s senile or incompetent.
What Biden did about the documents will never reach the level of what Trump has done.
The intention of the deed is the whole story.
If you have trouble remembering your loved ones’ deaths now, imagine if you were president and on the day that Israel was attacked you have to get interviewed by a SP that wants nothing more than to make you trip up on something so he can make you look bad.
Yes should have. As bad as the defamation of Biden’s faculties was in the report, the shit storm that would have ensued if Garland had not released report would have been an order of magnitude worse. “Biden’s corrupt DOJ covers up Biden’s crimes, refuses to release incriminating report.” Is a much worse headline than “Report calls Biden forgetful.”
And the reaction to it. Trump committed extra crimes on top of everything when trying to avoid being held accountable for having documents he shouldn’t have. Had he reacted in a sensible manner, none of this would have ever gone to court.
Would it have been appropriate for Garland to have Hur edit the bullshit about Biden being an old man with memory issues before the report was released? Or is this one of those “take it or leave it” deals?
I’m not sure, but I think the whole point is that the independent Counsel is independent, so pressuring him to remove unflattering comments might again make it look he was covering things up for partisan purposes. So I’d be loathe to do so if I were him.

I do agree with those who are saying Garland didn’t have much of a choice in releasing this report as it was. If he tried to rewrite it or not release it at all it would have likely resulted in more blowback, I think he made the right choice here. That said I am REALLY not happy with how he’s slow walked this investigation over the last couple of years. All of this should have been happening in 2021 and maybe even to the early portions of 2022. Real accountability does seem to be happening now in certain courts but Garland seems to value his own image as nonpartisan above the existential threat that Trump represents to the country much less the entire world.
About the memory thing to throw in my own two cents…
My own father passed away in 2006. I am 100% certain of that off the top of my head, but I couldn’t tell you the day or date I’d have to look it up. I can’t even tell you the general time of year. Summer I think?
Some dates stick in my head really hard though. My mother’s birthday is February 25th and I have a cousin whose birthday is February 22nd and I always confuse them since they’re so close together. And my second wife’s birthday is January 6th 1985. I can remember that date for very obvious reasons.
I agree that Garland had to release the report, and release it as written.
However, he could and should have ‘pulled a Barr.’ He should have, in advance of the release of the Hur report, released a statement detailing Hur’s GOP record. A few quotes from acquaintances about Hur’s obvious ambitions to rise within GOP administrations would have been appropriate, too. Garland could have finished by pointing out the timing of the Biden interview as connected with the October 7 attack.
It would have been both appropriate and, obviously, with solid precedent.
(Of course Garland should never have appointed Hur in the first place. Garland’s fatal flaw is that he genuinely believes that others in the DOJ value integrity above other considerations.)
