Controversial encounters between law-enforcement and civilians - the omnibus thread #2

Does any of that extend to filming a 3rd party in public? The question here was a little broader than filming the police.

Good point. Yes. I don’t want to spend the time going through the case law, but here is an excellent write up from the ACLU.

The cases I listed also specifically talk about filming an officer in the performance of his duties, so an arrest applies.
Finally, even if the court found a right to privacy in public for suspects, the suspect, not the police would need to assert the right (assuming the suspect is an adult).

A Southern California police officer searching for a burglary suspect on a February night opened the door of a portable toilet and found him. Seconds later, the unarmed man was dead.

Fontana police on Thursday released body-worn camera footage, narrated by Chief Billy Green, from the fatal encounter. Green said the man, Daverion Deauntre Kinard, was holding a “metallic object” in his hand as he sat on the portable toilet. It turned out to be a lighter.

But he was holding a lighter! He could attack a policeman with that.

It’s practically a flamethrower, after all!

A swarm of cops beat the suspect, then tackled and beat a bystander for filming. Not a single “good cop” in sight.

The resident gun nuts were defending a gun that looks like a cellphone. What could possibly go wrong?

Frightening thing is that one of them is a cop. Maybe ANYTHING “could be a gun” is a valuable tool in the LEO defender arsenal.

Holy shit! That was a fucking swarm of them. And the “few bad apples” saying is so incorrect. If only there was one good apple in that fucking bunch!

I take the smallest amount of comfort to know that there was at least charges brought against a few of the officers. There isn’t one officer there that should be allowed on the streets again. It appeared to be more of a gang brawl than a police enforcement action. The message those officers gave was clear: touch one of us, and we will beat you to an inch of your life. Disgusting.

Along with any bystanders.

The soon-to-be-rich bystanders, I hope.

Holy shit! And people say being blocked by Facebook is tyranny? you’ve got to be shitting me!

How about this?

“Scant evidence” is an exaggeration.

Two former Torrance, California officers are facing vandalism charges after they allegedly spray-painted a swastika on a car they impounded, the Los Angeles County District Attorney announced Thursday. More than a dozen other officers have been placed on leave after the investigation revealed they allegedly shared racist, homophobic and antisemitic messages,

Not the best OR the brightest.

Seriously, is prejudice a job requirement?

I think we missed this a few days ago; I know I’ve been busy lately and it’s hard to keep up:

Pennsylvania police chief suspended (for a whole 3 days) for harassing a pregnant black woman with her child in her car) for taking too long at the pharmacy drive through.

No real explanation as to why the officer elected to shoot at anyone, or how it came to pass that a bystander was shot and killed, but they’ll look into it.

To quote Jim Wright (again),

There are no accidents with guns.

accidentally carelessly/recklessly/stupidly shot …

Louisiana, again:

There’s a lot of wrong in this story.

“I’m not resisting! I’m not resisting!” Aaron Larry Bowman can be heard screaming between blows on the footage obtained by The Associated Press. The May 2019 beating following a traffic stop left him with a broken jaw, three broken ribs, a broken wrist and a gash to his head that required six staples to close.

State police didn’t investigate the attack on Bowman until 536 days after it occurred — even though it was captured on body camera — and only did so weeks after Bowman brought a civil lawsuit.

What does the footage show?

Then, in a big surprise move:

Also: “pain compliance”? How is this not just “a beating”? Calling things by different names doesn’t magically change what they are.
