I don’t think they’re required to do that (whereas the prosecution has to disclose relevant information to the defense). I’m sure there are reasons the defense might want to tell the prosecution about something like this - and other reasons that it might not do that, like if they’re only revealing part of what was said or if they’re shading the truth and know it wouldn’t stand up to scrutiny.

Per a clip played on the local news today, Sandusky’s lawyer is using the Michael Jackson inspired “he’s just a big kid” defence. Also “he’s a jock, it’s normal to shower together in groups after games” (that one’s paraphrased). I’m sure most athletes will agree; showering after a football (or other sport) game is exactly the same as showering with 10 year old kids after visiting a school late on a Friday night. :smack:

It’s patently ridiculous and kind of insulting to everybody’s intelligence, but the guy is entitled to a defense and his lawyer has to come up with something. Even if the guy is ultimately going to plead guilty, he and his lawyer will want to get the most favorable plea terms possible. It’s hard to believe any of this is going to make a difference, though.
I saw the Costas interview, and I just squirmed uncomfortably when Costas asked directly if Sandusky is sexually attracted to children, and he paused and waffled, and his response was pretty much, “Well, not sexually, no…” I mean seriously, if someone asked you, “are you sexually attracted to children?” wouldn’t your response be immediate denial and disgust? Even if you worked with a children’s charity and were trying to convey that you adore children, that would be a followup statement, I’d think.
That, and the horseplay line…eeeewwwww. Yea, we were horseplayin’…and we were naked in the shower…and maybe I touched a thigh…
Maybe he’s sick enough to believe it…but no, he’s guilty.

I don’t understand how hew he could be, unless he is part of the biggest sex abuse scandal conspiracy of all time. This isn’t about getting kids to admit to things that never happened (although who knows what will come out of the woodwork now with a potential victim’s windfall). If you read the GJ report, it’s pretty hard to mistake what you read regarding McQuery’s testimony.
Look at victim #2. McQuery claims that he heard a “rhythmic slapping sound” coming from the shower area that he thought sounded sexual in nature. He stuck his head in the shower and saw a boy with his hands against the wall with Sandusky, standing naked behind him, sodomizing him.
hmmm. This is from an adult not connected to any of the kids. I don’t see how this is being “misunderstood behavior” or “horsing around.”
I can’t imagine anyone who reads the GJ report will find him innocent of anything. He’s got a lot of behavior to explain, and that behavior, even if limited to what he said with Costas, was extremely inappropriate.

Agree completely with the post above yours and this about being “sexually attracted” to the children, and “horseplay” in the shower and other places.
The Sandusky camp is using horseplay as if they are going to be spending months going over what does and does not get included in horseplay.

I do not have any doubt that he is guilty.
There is no acceptable reason to be showering alone with a ten year old child at the PSU facility at that time of night.
The one question I wish had been asked is, what was he doing there with the child that night in the first place. What was it they were doing that required a perfectly innocent shower.
I would have loved to hear the answer to that.

I heard today that his attorney was asked if he would let his own young sons hang out unsupervised with Sandusky and he of course answered “Absolutely.”

I’m truly surprised this guy is walking around free on bond. I can’t believe that one of the parents to these kids wouldn’t want to take law into their own hands and beat the life out of this guy.
The judge who granted him bail was involved with Sandusky’s Second Mile charity. MPB in Salt Lake’s question “This actually happened?” applies to almost every single thing about this entire story.

I love how the (then) teenager - married to him and now divorced - responded on Facebook with “OMG did Joe just say he’d leave my kids alone with Jerry Sandusky?!”
Oddly hilarious response in this whole story. This thing is getting so weird that I’m beginning to reach the point where all I can do is laugh. If this were a TV show, we’d begin to talk about how it jumped the shark - there’s just too much weirdness going on.
Then I think about those poor kids (gah, even that… “think of the children!”) and I shudder to think about how this actually happened.
