This is the same logic that had conservatives demanding Judge Vaughn Walker recuse himself from the Prop 8 trial because he’s gay. It’s silly.

Anyway, there’s no evidence that Scalia hates gays. His Lawrence and Romer dissents suggest he doesn’t have much regard for them, but that’s not the same thing.

Firstly The New Yorker is extremely well respected in general for the quality of their writing. However, it is not nor has it ever been a straight news magazine. They’ve always had satirical pieces, but yes they are usually better than the linked article. To muddy it up though, that’s not technically a “The New Yorker” article, it’s a post on a staff blog. It can be confusing, but in addition to having staff writers who write “real” articles that appear both online and in print and are typically subject to the normal review/editing/approval process a lot of media outlets also host blogs where some of their staff writers post random stuff oftentimes with little to no exercised editorial control. These blog posts are not presented or expected to be the same quality of articles appearing in the main publication. In particular, this blog, “The Borowitz Report” appears to specialize in relatively weak modifications of real news stories for comedic effect–basically an unfunny Onion.
