Well, since there is no such thing as stalagtites, and it sounds very close to stalactites, that would be pretty nitpicky to mark wrong.

In general, this not a show where you lose for getting it slightly wrong, like you would on Jeopardy. They often go on intent on anything questionable.

What if the guy who hops in the cab happens to be a convicted felon out on parole? Don’t most game shows and reality-based TV shows in general have policies against allowing such people to make an appearance on the show? Do they check people’s backgrounds afterwards to determine if their appearance can be aired?

Slight hijack: Does Ben Bailey (the cab driver/host) have to memorize all the questions and answers ahead of time since he can’t be reading them while driving, or does he have some sort of prompting system, such as an earpiece where someone else via remote reads him the question and its answer?

The answers are in Otto’s link above (it links to page 2 of the story, be sure and go back and read page 1 as well). Contestants have to sign a waiver that they meet eligibility requirements (not shown, takes 15 minutes) and questions are read to Ben through an earpice while he drives.
