Dissent and Sedition

On another message board, I got into an arguement with a military person who claims that military people who say bad things about Bush and the Iraq war can be convicted of Sedition.

I responded that the Hatch act allows military people to voice their politcal opinions as long as they don’t use mix with with their position(don’t claim to represent the military with your opinion, don’t wear a uniform at a political rally, don’t where a politcal slogan on your uniform).

I’m not sure about the sedtion part, but if it were that easy to convict, I would think a lot of people would be court martialed for sedition and we would have heard about it. Also, I would think sedition would actually invovle helping the enemy, or disobeying orders, or something like that.

And while not directly invovled, I’d like to be able to back up the position that one can believe Bush is an idiot and still be a patriot, preferably with qoutes from from people that an intelligent military person or conservative would respect.

He probably wouldn’t be charged with sedition. An officer whose criticism of the president was intemperate might be charged with Article 88 of the UCMJ, “Contempt toward Officials”, which states:

A DOD directive extends this prohibition to non-commissioned officers and enlisted men
