So, it’s legal to drink and drive in Texas (and Oklahoma) as long as you aren’t above the legal limit(obviously). But if you are drinking while in the driver’s seat, wouldn’t that be reasonable cause to be pulled over? Or would you have to be swerving?

It is just my opinion but i’d consider the sight of someone with beer-to-mouth while driving a car to be a pretty :eek: worthy sight.
It was legal to drink while driving in Texas for most of my life, but that changed several years ago. Now, you don’t even want to think about it. There’ve been several iterations of law as the legislature has segued to the current law, that is as restrictive as most states.
Texas currently has a no open container within the passenger compartment law, and the BAC for a DWI is 0.08% - the same as most states. Discussion ensued at one point, and I don’t know what the outcome was, towards making transport of even sealed containers illegal if within the passenger compartment (Texas legal beagles?).
So, DWI laws here are as tough as anywhere else in the U.S.
Back in 1970, I was hitching on a cross-country trip with a friend. We got picked up outside Austin by a couple of hippies who’d just got off work, and who both had a 40 oz. beer sitting on the dash. On the elevated portion of I-35 that passes through the mddle of Austin, Texas, we were pulled over.
Must’ve been a slow day for APD, as we drew five cop cars. They surrounded the car and one guy took the lead. He just shot the shit with us a little bit and finally said, “Well, we got a call that there was a car full of drunk hippies on the freeway, but y’all ain’t drunk yet.” And waved us on.
Things are different now.
