Drunk driver arrested and car towed - what do police do with drunk passengers?

I was a passenger in a car where the driver was busted for pot. For whatever reason the police allowed me to drive the car home.

I was pulled over by a cop after a New Year’s Eve party and he repeatedly made me take the breathylizer, but it would only come up 0.59 so I wasn’t intoxicated enough to even be charged with driving less safe, let alone DUI.

The cop drove made me leave the car on the highway, and he dropped me off at a motel. I had to hitchhike to my car the next day.

I have to believe there’s a typo in your number. Here .08 is considered intoxicated.

0.8 is a DUI but blowing a 0.6 you can still be charged with driving less safe, might vary by state though.

Well, if you’re a cop in a rural area somewhere between Central Pennsylvania and the Jersey Shore, the answer is “give the keys to one of the passengers and let him go”.

This happened to my brother. He and his buddies decided to start their celebration early when they went to the shore for the weekend. Got pulled over, brother got arrested (for good reason!)… buddies went on to the shore without him (in his car!!).

I have to assume that’s part of why my brother only spent 36 hours in jail, versus a longer stint: that the police had handled it so very, very badly.

First my parents heard of it was a 2 AM phone call that was so incoherent they had no idea what was going on. The next they heard of it was when they got up a day later and found my brother’s car in the driveway, with no brother in sight. His “friends” had gotten back from the beach and dropped the car off.

This was 30+ years ago, for what it’s worth; I suspect the outcome would have been quite different these days.

Similar to Mamma Z’s story…Summer of '81 my ship had just returned to Pier 5 in Norfolk VA after a 6 month deployment. Two of my buddies, Skeeter and OnionHead and I took off In OnionHeads 67 GTO convertible.

We made a bee line to the Outer Banks of NC. Just past Nags Head the lights came on behind us…OnionHead was busted, speeding, open container and possible DUI. The Cop asked if either Skeeter or I was OK to drive, Skeeter said yes; he was not! Skeeter and I followed the Cop and OnionHead to Manteo NC on Roanoke Island.

They never breathalyzed OnionHead, just fined him for speeding and open container. They didn’t even take our beer and never even looked for anything else (we were just in from the Mediterranean and had a shit-ton of hash)
They let us all go that night after posting $100. Never even came across the Captain of the ships desk.

Times were much different back then.

Names have been changed to protect the guilty.

We have sent people to the hospital because they are drunk but only when they are so drunk it’s physically dangerous and they are in no condition to refuse or be able to take care of themselves.

.8 is certain death.
.08 is DUI.

Think you slipped a decimal there. Googling the subject gets a consensus that 0.4 BAC is “alcohol poisoning, coma likely, good chance of death” territory. 0.6 is quite likely to be “do these shoes go with this bodybag?” level.

Yeah my bad I meant .08 and .06 respectively and I blew a .059

Now if it had been the town of Jersey Shore back then or similar places around Central PA and/or the Wyoming Valley/Endless Mountains ---------- they would have beaten the snot out of him, let him heal and sober up for a couple hours, and sent them all on their way. Even today there are a couple towns where I couldn’t get arrested; nor could you. Arrests mean paperwork and with that dark space behind the Municipal Building ------ :wink:

When my cousin got picked up drunk they took me and my drunk buddy to the nearest 24 hour Walmart and told us to find a ride home. We bought beer.
