eBay transaction headache

I agree that this appears to be PayPal’s interpretation in this case, the interpretation of ebay(even though it’s the same company), the interpretation of a court, and the interpretation of a court outside of the USA, may differ.
I’m almost certain that a court in the UK would not accept ‘deliver’, in the context of a transaction, to be so liberally defined as “propel in the general direction of”, at least I would hope that to be the case.

It seems the pair of you are communicating and are on good terms (no feelings of blame or wrong doing). I think you guys should spilt the loss 50% each and call it a day.

Shit happens sometimes. This really looks like a no-fault issue between you (the fault seems at USPS or a 3rd party we don’t know about). Why not share the load, shake hands, and end the deal knowing you both worked an arrangement fair to each other?

This makes sense, and Chris did offer that up front, but neither one of us really see it as our fault, even 50%.

Chris sees it as his responsibility ended once he got the item to the shipper.

I see it that Chris had a responsibility to use proper packaging.

Chris doesn’t want to have to pay for the shipper’s mistake and I don’t want to have to pay for the shipper’s mistake OR what I consider to be a packaging mistake.

While this conversation has been very civil so far, I still feel that this private disagreement would best be handled via snail mail and/or e-mail between the two parties. I think I’m going to lock off this thread.
