Fuck you, Rowan County (KY) Clerk Kim Davis

I just saw a report that so far, three of the deputy clerks are caving in.

Three have agreed to perform marriages so far. Hearings ongoing for the other three.

I bet the reason is they knew she was in it for the right-wing lecture circuit and ghost-written book…and that they would be seeing none of that.

We know that one of them was willing to issue the licenses all along and one declined to state their views. It’s probably safe to say they were two of them. The other probably didn’t want to go to the big house.

So what happens once the plaintiffs in the existing suit are all granted marriage licenses? What happens to Davis if she agrees to grant marriage licenses again on the assumption that there won’t be any more gay couples applying for licenses?

Here’s an interesting story about how Davis has already unknowingly issued a marriage license to a trangender couple. She issued the licence in February to a couple, one of whom had had gender reassignment surgery. Even though poth of them had birth certificates identifying them as female, Davis apparently didn’t notice. This was back at a time whe could have declined legally to issue the license.

So she’s also incompetent. Why does this not surprise me?

It’s a very good bet she’d be released, and slapped back in jail again should she renege on her promise.

Given her hard-won notoriety, that is a very bad assumption. I think you’d see more SS couples going there to get licenses, to prove a point or even if only to rub it in.

Five out of six of the deputy clerks have agreed to issue licenses. The one hold out is Kim’s son. He will go to jail.

Licenses will begin to be issued at 8am tomorrow.

I’m fine if she holds firm and just rots in jail. Now that marriages can proceed without her, there’s no reason for me to ever see her face again. And the good thing is, its all her own doing

Issuing licenses to those who are legally allowed to marry is part of the job. She doesn’t get to second guess who falls into that category.
We know a guy who has been in the Air Force for ages working as a supply clerk. he has about as much chance of killing someone as I do. However, if something happened where he had to, he doesn’t get to object.
Not that he would. He’s a good Christian.

Having her name on your marriage license might make it a collector’s item one day.

I hope it becomes the most popular same sex marriage destination in the country.

Might be a good time to open an upscale bed and breakfast within walking distance to the Rowan County courthouse.

What law need to be cited to verify that if she’s in a jail cell, she has been literally and physically been removed from her office?

Her job did not change one iota. Her job was to determine whether a couple met the legal standard for marriage, and issue a license if they do. Her job never involved determining whether that or any other standard was was legitimate.

But she won’t. She said she wants to “have a voice for God’s word.” As soon as she’s offered a speaking position in some Evangelical organization, she’ll proclaim it a vindication from God, who wouldn’t let her be silenced. She’ll quit her office and be released. It’s exactly what she wanted the whole time. So … everybody wins? Yay?

The alternative was an ever-increasing fine that takes into account likely donations and future remuneration through speaker’s fees and book deals. The only downside is that bankrupting her for life doesn’t have the immediate, visceral appeal of making her spend the night in jail. Oh well.

BTW, why is this case the cause célèbre right now, when other clerks in Kentucky, Alabama, and possibly Texas are also refusing to issue licenses. Why do we care more about Kim Davis than the rest of them?

It’s certainly fair to parse things that way. It’s also fair to say that her job did change, because it did. That is a fact. One day she was not to required to issue licenses to SS couples, the next day she was.

The one that conflates physical removal from office with loss of that office.
