Gay couples in Kentucky are questioning the validity of altered marriage licenses issued by a defiant county clerk and have asked a federal judge to order her to reissue the licenses or put the office in receivership and have someone else do it.

When she returned to work last week, she confiscated the marriage licenses and replaced them. The new licenses say they were issued not under the authority of the county clerk, but “pursuant to federal court order.” Davis said this accommodation preserves her conscience while also granting licenses to same-sex couples.

But on Monday, lawyers for the American Civil Liberties Union wrote that the validity of the altered licenses is “questionable at best,” and that the new licenses bring “humiliation and stigma” to the gay couples who receive them. They asked U.S. District Judge David Bunning to order Davis’ office to reissue the licenses. If Davis interferes, the lawyers say Bunning should place her office in a receivership for the purposes of issuing marriage licenses.

“The adulterated marriage licenses received by Rowan County couples will effectively feature a stamp of animus against the LGBT community, signaling that, in Rowan County, the government’s position is that LGBT couples are second-class citizens unworthy of official recognition and authorization of their marriage licenses but for this Court’s intervention and Order,” the lawyers for the couples wrote in a court filing.

If I read/understood the statutes correctly, the signature of the deputy would have sufficed - it still needed the clerks office and county on them as well.

Which, my understanding of the first couple of licenses issued, did - but not the one once she went back to ‘work’.

I don’t know if this is Bunning’s jurisdiction. Only the state can decide if they’re valid, Bunning’s order is only to issue licenses. Issuing faulty licenses might qualify as shenanigans, but I don’t think he can decide whether they’re faulty or not.

Whoever decides this, it should be hard for her to defend against. She maintains that the licenses issued without her signature are invalid and surely the alterations she has done since haven’t done anything to help the validity. By her own logic, if they were invalid before (the country and state disagrees), her alterations should make them WAY invalid now.

Bunning can decide if Davis is complying with his order, and can order her to issue valid licenses if necessary. What he can’t do is declare the licenses valid himself.

That emboldened her so that she feels she can do what she wants, since she did not submit to a “lower” authority and, in her mind, the “lower” authority was “powerless” against her and her god. Put her back in jail and let her rot there until she relents.

I don’t think the court would have any problem with that. So long as they are legally valid, the court shouldn’t give two fucks about what is valid in god’s eyes.

I don’t care about her past marriages or her views on same sex marriage, but this traitor needs to start following the Constitution that she swore to uphold. That’s capitulation. To either uphold the Constitution or get out of the way of people who do.

“They’re not valid in God’s eyes, for one… And, um, you know, I think the authority… I have given no authority to write a marriage license. They did not have my permission, they did not have my authorization.”

So, I dunno, take that for what it’s worth.

People throw around words like “delusional” and I don’t give it much thought, but after watching that video… well, she really creeps me out.
