What a poor decision by Kentucky. Attorney’s fees generally only get rewarded when the case is essentially frivolous. They are thus supporting frivolous lawsuits. “Go ahead and sue for whatever! We’ll pay you back!” they are announcing.

If you put that penalty on Davis, you’re also rolling the dice as to whether it’ll ever get paid. She almost certainly doesn’t have a quarter million to spare, and it’s not a sure bet that she’ll be able to raise that much from her fellow travelers again. Having the state pay it out guarantees that nobody who put hours into resolving this case gets stiffed. Not as viscerally satisfying as putting a shitty little bigot like Davis in the poor house, but probably the fairer way to handle it over all.

Yes, I understand what is happening, you goddamned fucking assholes. I just fucking read it. Kim Weber is not only responsible for a judgement, but also attorney’s fees. That she is responsible for attorney’s fees means that her entire fucking lawsuit had no merit from the beginning. That’s why such fees are given. Otherwise fees are not returned. I just found that out from an actual fucking lawyer. Furthermore, a lawsuit that is brought when the lawyers know it has no merit is commonly called a frivolous lawsuit. Kim Weber’s lawsuit is frivolous, because she and her lawyers knew she had no right to do what they did, and decided to roll the dice.

But Kentucky has offered to pay this instead of her, which you guys just quoted. Which means that Kentucky is paying so that Kim Weber doesn’t face the actual consequences for her actions. It also sends a signal to other people with similar suits that they can also sue, and, if they fail, Kentucky will pick up the tab.

If you want to challenge anything I said, I’m fine with that. But attacking me without even bothering to challenge anything only implies you don’t have any counterargument. You can attack me all you want, but you’d better actually have something to back it up.

You are wrong by just about every measure here.

First, who the fuck is Kim Weber? The Rowan County official’s name is Kim Davis.

Second, the judgment does NOT say that Davis is responsible for a judgment, or for attorney fees.

Third, it does not say that “Kentucky has offered to pay this instead of her.” The judge explicitly said that the state of Kentucky had to pay the costs.

Fourth, nor does this judgment mean that “her entire fucking lawsuit had no merit from the beginning,” because she was NOT the one who brought the fucking lawsuit.

The plaintiffs, the people who brought the lawsuit, are the gay couple to whom Davis refused to issue a marriage license, in violation of their civil liberties. They won the suit, and the judge said that, because they prevailed, they deserved to have their legal costs covered.
