Snipped. No, you don’t. 42 USC 1988 allows Federal courts, at their discretion, to award “reasonable” fees for cases involving civil rights. It has literally nothing to do with cases having no merit or being frivolous. Nothing. Nothing!
The main issue the Federal judge was dealing with was whether Rowan County or the Kentucky Commonwealth was on the hook when the judge decided to award attorney’s fees. Kentucky didn’t step in and offer to pay the fees.

Yes, this was my thought. And this is why I think the taxpayers should bear the costs, since otherwise the plaintiff’s lawyers would not get paid at all. Of course, it’s unfair on the minority of Kentucky taxpayers who would have been on the right side of the issue in the first place; but how else could this work? If the taxpayers don’t like these consequences, they can express their feelings through the ballot box.
If you’re referrimg to the people of the state, then you don’t know bigots. Now, of course I know not everybody in the state of Kentucky is a bigot. But it’s a guarantee the bigots who are there will proudly whine about how unfair these court decisions are and, if Davis were eligible to run for political office again (I don’t know if she’s eligible or not), they’ll vote for her because she’s a damn martyr and a “good Christian”. As an elected official, Davis couldn’t be fired, only impeached by the General Assembly, which was not in session during her pathetic stand for her hateful ideals.
The State and only the state has the authority to permit marriages. The State chose to delegate this authority to elected county officials. The State had the authority to convene a special session to dump the dodo. From top to bottom, the state held responsibility, but it failed to meet its responsibility, so it is now being held responsible by the court.
