Sorry, in fact, I did have a short term relationship. But since she was allegedly 31, and looked about this age and had a day job and an appartment, I suspect the likelihood she was actually 12 is pretty low.
Although she could have been legally incompetent, and I was careless enough not to ask for a psychiatric evaluation and an investigation in the civil courts records, shame on me!

I think the point is you try and verify age (to the best of your ability) before things start getting hot and heavy.

This. And that nobody actually has to go to these extremes, because it’s not actually hard to tell if the person you are having sex with is a preteen. If for some reason you find that a hard distinction to make, you need to take extra precautions.

If this was an ongoing and known issue the girl and/or her parents could be charged for a number of things. Allowing your twelve year old daughter to be in repeated situations where she is being raped(statutory) is certainly going to trigger the state to question your ability to care for a child. If they have evidence the girl is lying for the purpose of encouraging illegal activities she could be charged as an accomplice to her own rape.

It’s pretty simple for ‘good’ boys to avoid being convicted of rape.

If you don’t know how old someone is don’t have sex with them. Hold your partners to a higher degree of scrutiny than ‘they said so’

I really don’t feel bad for people who have sex with minors regardless of the events that lead to it. So no they aren’t ‘good boys’

If there is a serious issue in this country of underage harlots purposely lying about their age to send people to jail throw up some examples and we can talk about the different options the state may have to stop it from happening.

Yeah, no. In some pictures she looks as old as 15, but not 18.

If the exceptions for “known harlot” have been removed from Statutory Rape laws, they need to go back in while we decide if hormones will be allowed to play out as they have for generations without ruining any more lives than absolutely necessary.

For a case: Roman Polanski. His actions are indefensible, but: What the hell was that child doing at that party? Was she removed from her parents/guardians?

Yes, it kind of is. At least if you’re aware that, you know, if the guy has sex with you, then he will get locked up in prison, and isn’t going to be able to look at yooooou (or do anything else) for the next ten years.

I think strict liability laws (for anything) are a dumb idea, but I have enough faith in human nature to think that girls who lie about being underage, to a potential love/sexual interest, are probably pretty rare.

No, the child involved is an example of a kid who was in a place a kid should not have been (I heard it described as a “party”) and doing something she shouldn’t have been doing (Listening to a sexual proposition from Polanski).
I was asked for a cite of a child who probably was not a stranger to the world of sexuality. This one would seem to count - if she was at a sedate photographer-and-model-spending-2-hours-to-get-a-good-shot and nasty R.P. grabbed her, where was her parent? On whose say-so was she there?
If this was a couple of dozen hot models getting folio shots, there might be a few males around, and a party could ensue.

Who brought her, why didn’t she/he notice what was going on? Maybe they were encouraging it - a parent pimping a child is not beyond imagination. Hollywood is about trading favors - supplying “Young stuff” to Polanski might have been a shrew political move.

This is not a jury trial, because the court ruled the accused HAD NO LEGAL RIGHT to present to the jury evidence about whether he “clearly thought” the young lady was an adult.

He was 25; she allegedly told him she was was 22 and a university student (she was really 13). He wanted to present, among other evidence, her MySpace page where she represented herself as a university student. The trial judge refused to allow him to use a mistake-of-fact defense or even tell the jury about why he believed she was of age. How clearly he was thinking or how credible his belief were not even issues, because it didn’t matter what he believed.

He appealed, and the appellate court upheld the decision: “It would be unconscionable for us to allow a 25–year–old man who was having sex with a 13–year–old child to claim that his actions were excused because he reasonably believed that he was having sex with an adult. Such a defense is precluded by the overriding interest in protecting children.”

In other words, in the state of Texas the jury does not get to decide whether to excuse the man on the basis he clearly thought the girl was an adult; it’s not the jury’s decision to make, so they will never hear or have a chance to believe “but I thought she was older.”

So if a child is a slut, then it’s her fault if some adult man has sex with her?

The point is, she’s a child and we do not believe she is responsible enough to consent to sex. If she’s hanging around in adult situations and acting all slutty, it’s because ADULTS in her life have failed her, not her fault because she’s a whore.

The notion that if a 12 year old is a whore that makes it OK for adults to fuck her is…well it’s something.

I guess i’m not the only one wondering, so here’s a picture of this girl. Although the ay the picture is taken, it’s difficult to tell if she could pass for 19 in person. I guess it’s plausible.
