I have read the thread. And I say that the OP is sadly mistaken about what the first amendment does and does not cover.

I think it’s part of his “character” in the commercial; “You let me take on the gov’t, you have enough to worry about…” Anyone who wears cowboy hats seems to dislike the gov’t, it’s become a sort of anti-gov’t symbol.
I prefer Edgar Snyder myself. “There’s never a fee unless we get money for you!” 
That’s just 'cause the government always wants to increase the price of Marlboro reds.
Actually, I wear a cowboy hat, and I’m a damned yellow dog Democrat. There are some parts of the government I don’t like, and there are other parts I do like.
