The squirrel isn’t dead - it’s hiding from the hawk by holding onto the bottom of the branch with its teeth.
That would be the hawk keeping it on its toes.

I believe it’s a broad-winged hawk. OP, can you confirm that fits in your geographic range? I’m guessing eastern US because of the fox squirrel, but they’re introduced in many areas.

Seriously, that is a cool photo. There is a pair of American kestrels near me and l have watched them take small birds at my feeder.

I sent the picture to my sister, an avid birdwatcher and Audobon member.
She says it is a juvenile red tailed hawk, the bars on the tail being a mark of younger age, as well as the spots on the back. She also points out there are a few flecks of red already to be seen.
You can certainly see a hint of red in the tail.
That’s interesting that she says it’s a juvenile. It was originally on the ground when I came upon it, and it took off into the tree pretty effortlessly with the squirrel in its grasp, so that seems like rather impressive strength for a juvenile, but I’m certainly no expert on birds.
Think of him as an older teenager, not a kid in elementary school.
