I’m guessing this may have been asked before, but I can’t find it. How frequently can I be ticketed for the same non-moving violation? Say I’m illegally parked, or my registration has expired, or some such. Can I get a ticket once a day? Once an hour? Can the cop just sit there handing them out as fast as he can write them?
You mean like Homer vs. New York?
Just to clarify;
Like if you’re parked in a 30 minute zone, can you get a ticket every 30 minutes?
Is that what you’re wondering?
OK, lets narrow it down to one specific infraction. Lets say my registration has expired. Last time I got busted for that it was a $50 ticket. So imagine I park my car in front of my house, and leave it there for a few days. A cop comes by, notices my sticker is expired and writes me a ticket. Can I be ticketed again for that offence? If so, when and where?
You can be ticketed as often as an officer notices the violation, but in my experience, the first time you show up in court for the offense the judge will treat all the tickets as one. He will also likely get pissed at any cop who wrote a ticket an hour for something like that. As for the 30 minute parking example, a ticket each violation period is entirely possible.
I don’t think there’s any universal rule. In the example of the car being parked on the street, w/ expired registration, I suspect that, in most jurisdictions, the car would be impounded and towed. This could be done after a preset period of time, probably ranging from 24 hours to 3 or 4 days. This would vary widely from jurisdiction to jurisdiction. Of course, some places use the “bbot” instead of towing.
There have been a few times where I got pulled over, and the policeman asked me, “Do you realize that your inspection sticker expired?” On a few of those occasions, I was able to truthfully and respectfully respond, “Yes, officer, I’m very sorry. I got a ticket for it yesterday, and I’m trying to get it to the inspection station soon.” Because I was able to show him the ticket I had received, and so he believed me, he always let me off with a warning.
I didn’t bother trying that on the occasions when the ticket was already more than a few days old.
Yeah, I’m a bad procrastinator. I’m really trying to be better. (Probably tomorrow.)
In my experience, it depends on how close together the tickets are- a ticket an hour for five hours, all but the first will probably be dismissed. A ticket a day for a week is another story.
Here is someone that got 3 in one day. I have seen other posts at that forum from folks that have received multiple tickets in a short amount of time.
