I’m sure many would say I’m being over the top, but I sincerely believe that if RBG dies before 1/20/21 (or 1/3/21 should the Senate go blue) that humanity is looking at a future that looks a lot more like Hunger Games rather than Star Trek TNG. We still have a narrow window to turn things around, but it’s going to be close. If Trump wins, I think that’ll be all she wrote.
If enough ppl see Trump as a millstone, they MAY abandon him in a SC nomination. Only a few need to to it to prevent confirmation. He looks to be hurting down-ticket republicans - the question is, do they double-down and try to energize the base by getting another SC ‘win’, or start to distance themselves from him.
My bet is they stick together as a group 'til the end, as it’s probably too late to break away and have it help them in November. This has been what they’ve done for what, two + decades? They’ll stay with the strategy until it is proven to be a losing one. I know McConnell will attempt to seat another conservative SC justice if he possibly can, as sure as the Sun rises in the east, and he’ll probably get the votes to confirm.
If Ginsburg dies shortly before Election Day, there is no reason any Republican senators would shy away from voting for a conservative nominee replacement. Voting in favor of a right-winger to replace Ginsburg would massively juice their voter base; voting against such a nominee would lose enthusiasm votes while not gaining a single Democratic vote. There is every electoral reason for an R senator to vote yes and none to vote no.
The most that I could see happening is that they would claim to be distancing themselves from Trump before the election but they would downplay as much as possible the nomination question if they can. Then, once they’ve secured re-election they can go back to voting for all conservative nominees like they did before (even if they don’t give them vocal support).
We would only need to peel off four senators, and I think there’s a decent shot of that. Not a sure thing by any means, but that’s less than ten percent of the caucus.
Good point. It could be a short-lived, pyrrhic victory for them. I wonder sometimes about where that would end, but I guess if we can have 435 members of the House, we can have a hundred or more SCOTUS justices.
