Is Eskimo Joe's a ripoff of Eskimo Pie?

i have been hearing for years debates about who created Eskimo Joe’s logo/trademark. I found the answer when I looked at an eskimo pie.
I think. Are they not close enough to engender a trademark violation lawsuit?

Seeing as how the U.S. Trademark and Patent Office granted them a trademark in 1988, they must not be in violation.

Judging from the links provided by Peter Morris, I’d say the only similarity is they both use the word Eskimo. How can one think these two logos are close enough to be an infringement?
