I doubt there would be enough voters turning out in the midterms to change control of either chamber of Congress to such a degree that any action will ever be taken.
Hogseth and company would be likely to clamp down harder and start disappearing anyone who protests. So it’s a win all the way down for the Orange Monster.
That’s all the current president needed to justify calling out the National Guard in DC. Of course it’s diametrically opposed to his and other republicans’ talking points about that very same authority way back on January 6, 2021.
That is the problem, isn’t it? Federal judges have little recourse to force Presidents to do anything.
I believe the actual remedy is for Congress to rein in the President through appropriate legislation and the threat of impeachment.
But they’re running scared of MAGA/Trump, so they’re basically abrogating their responsibility in this regard and letting him do what he wants.
Oh, they’ve doing more than just “abrogating their responsibility”. In passing House Constitutional Resolution 14 (I will not refer to it by the demagogic title) into law, they’ve enabled Trump’s autocratic ambitions in numerous ways and funded a paramilitary organization outside of the scope of the Department of Defense and the restrictions of the Posse Comitatus Act. They are cowardly enablers and many of them willingly complicit collaborators with a nascent fascist regime.
