I saw a piece on CNN this morning. They analyzed one of Trump’s ads that quoted newspapers predicting doom and gloom if Harris were to be elected. The reporter looked up the actual articles that were selectively quoted, and the full quotes were nothing like what was implied in the ad. One was even from 6 years ago.
Ron DeSantis’ government tried to shut down a Florida abortion ad on the grounds that it was false. A judge shut it down with a blunt quote: It’s the first amendment, stupid.
Now, if a candidate lied about a particular person, that person could sue for defamation. But that’s the best I got.
I guess I’m asking about when a candidate lies about another candidate. Not just exaggerating their policies, but outright says defamatory personal complete fabrications.

I think the uppers they’re pumping him full of to keep him lucid are starting to run him ragged and they’re having to work harder to hide it, like when Mae West was still trying to play a sexy coquette in her eighties and they had to coat her in makeup and shoot in soft focus to try to hide how old she looked.

Most interpretations of the 1st Amendment is that it offers its strongest protections to political speech and courts take great care to avoid trampling on those protections. Commercial speech has fewer protections which is why advertisers can’t outright lie about what their products do, the ingredients, prices, etc., etc.
Plus there’s the higher standard for proving defamation when you’re a public figure.
