If you were following the case as closely as this thread, you would be aware that JP was very much alive and actively coaching the team at the time the other two were charged, and the prosecutors explicitly said that his behaviour complied with the letter of the law. (They did condemn him for moral failings.) So your assertion is apparently incorrect.

More generally, ISTM in light of the above that consistent speculation that JP did not meet his legal requirements has a high hurdle to clear, in that the judgment of those more qualified to make it - and who were obviously not enamored of him and his role in this affair - was otherwise.

While it’s true he reported it, per email, if he influenced others not to report, it’s possible the prosecution would go after him for that (not sure what he would be charged with in that case).

Joe Paterno died in January, 2012. The Freeh report, which contained damning evidence of Paterno’s involvement, was not released until July, 2012. In case math isn’t your strong suit, suffice it to say that the evidence against Paterno was brought to light AFTER his death.

And for the record, the Freeh report was not some sensationalized tabloid report whose purpose was to sell papers. Penn State’s Board of Trusties hired the Freeh Group to investigate. And lest you think there was some conflict of interest and the Board was trying to scape goat JP, I’ll remind you that the Freeh report was damning to the Board as well. The Freeh Group’s overall findings blasted the board because it “did not perform its oversight duties.” And Graham Spanier may still be charged, though imo he is far less culpable than your beloved JoePa.

And FTR, I don’t give a flying fucktube if Spanier, Curley or Shultz are convicted of anything. The only one I want to see locked up for life is Jerry Sandusky since that is the only thing that will keep him from raping more children. He is a sick man who needs to be removed from society.

But the horrific tragedy in all of this is that so many young boys were failed by every adult around them. So the fact that Joe Paterno et al will forever be remembered as moral scumbags is a small price to pay compared to the burden that will be carried by all of the victims for the rest of their lives.

That may be how they will be remembered by knee-jerk loons who don’t care about the truth or people who were never exposed to it in the first place, but there are those of us who know better and we know those people are wrong.

The feeling of smug superiority this creates is unbecoming, so we try to fight it.

You were specifically talking about “lying to the grand jury and failure to report child abuse”. The Freeh Report didn’t change anything WRT whether JP met his requirement for reporting child abuse. And your cite notes the difficulty of proving perjury charges against someone in JP’s situation.

You make an excellent point. It would certainly be very difficult for the DA to charge and cross examine a defendant who is dead. I suppose you and SA can celebrate this as JoePa WINNING!!!

It can be argued that both Paterno and Spanier are equally culpable. On paper, the buck should stop with Spanier, but I think you underestimate Paterno’s power at Penn State.

Paterno absolutely had the clout to take a tough line regarding the Sandusky issue. But he chose not to. Moreover, if a janitor feared for his job if he reported an incident of child abuse, that doesn’t say a whole lot about the culture Paterno created around his football program.

But I’m willing to concede that both of them are responsible for allowing Jerry to rape more kids.
