James Bond theme: Can I distribute it in an email?

I downloaded the original James Bond theme song (dun-da-da-dun-dun…) from here. Do you think I can attach it to an email and distribute it freely? It is from the 1962 “Dr. No” I don’t know if any copyrights or ??? would be broken by me using it. I see no warnings on that site either. If not this exact one from this site, is there one I could use?

We are putting together an alumni event with the 007 theme and I’d like to send the invitation with this song attached. I’d also like to turn it into a ringtone to distribute too…

Speaking just for myself, I’d be annoyed if I got an email with a 1-1/2 megabyte attachment.

It looks like that song is, indeed, copyrighted. I don’t know whether that Web site is distributing with permission or not. You could always include a link to the site, which makes it their problem instead of yours (and gets rid of the big fat attachment, too).

Did you read the notice on the site?

I have no idea why these folks are able to make this material available in the first place. Also, it seems very strange to post free material to a web site but then say you are not allowed to reproduce it. Nonetheless it is copyrighted material.

Just try to remember that copyright in fringement is not criminal law, but civil.
No one can call the police on you, the owner would have to sue you. And what can they sue for? Only damages. So go ahead. You will never be worth anyone suing you. It costs money to sue. And what would they claim as a loss? A lot less than the fees.
Now if you sold them they might object. But with any lawsuit a demand letter asking you to desist must come first or the judge will throw out the case.

Besides, I have already converted it from 196 bits to 48 bits. Probably could go even lower and get a 100k file that still sounded fine…This is just for an invitation.

There are 100’s of different versions of the song ALL over. Google “James Bond Theme” and you’ll get many pages with the song on them. I just want one. It could be a stupid digital piano sound for all I care. I just want the file embedded in my email for added effect.

It doesn’t matter if other people are infringing on the copyright: the James Bond theme is copyrighted and distributing it – in any way – is a violation.

It’s also very inconsiderate and annoying to include something like that as an attachment. Some people may be on dial-up. Others may not want to hear music in their e-mail. Why piss them off?

IANAL, WAG and so forth, but if the song is copyrighted, and not by the people who run the site you are getting it from, and they have yet to be sued, do you think whomever owns the song would care if you put it in an email? As for the other comments, people on dial-up deserve what they get :slight_smile:
