Actually, that’s the kicker. Lousiana law is unique among the states for having its roots in civil law, which I don’t have much expertisein… so I’d be very hesitant to start looking up case law and claiming I understand its precedential value in Louisana.
Well, I doubt there’s a huge difference. But if you think that Louisiana law adds more uncertainty to the analysis, I think that supports my argument that the charges are not outrageous on the surface.
