What kind of guardian or conservator lets someone mentally incompetent stand up in an open forum and rant crazy talk like that? Even if they agree with her POV, surely they realize that particular presentation is leaving her wide open for mockery.

I’m not sure if conservators have the legal authority to prevent someone from doing something that isn’t illegal or physically harmful.
In the 1980s, I worked for a probate law firm and we were the conservators for several people. As conservators, we paid their bills. If the person wanted or needed something that was outside their usual bills and monthly allowance, then we had to petition the court for permission to give them the money for the purchase.
For example, we had one client who wanted to buy a TV for his room. It was more than his monthly allowance, so we had to petition the court for permission to buy him a TV. Once permission was granted, we purchased a TV for him.
In general, as conservators, we were not allowed to control the person’s behavior, beyond identifying anything that was potentially and petitioning the court for assistance.
So, just because a person might be a certifiable nutjob, his or her conservator does not have any legal authority to prevent that person from spouting anything on the Internet, unless one can show conclusively that such behavior is dangerous to the individual. Good luck with that.
I’m not sure the outrage expressed against the lady’s brother is justified. He may be doing everything the law allows him to do.
How are we supposed to know she’s crazy? I’ll bet she would have been interrupted for applause a dozen times if she had delivered that rant to some of the groups that Santorum and Bachmann pander to.

Frankly, I blame the unaccredited nutjobs for making a paranoid schizophrenic sound practically mainstream conservative. She’s kind of a live and in person example of Poe’s Law. Is she crazy or is she actually, you know, CRAZY? Fortunately, we now have the documentation proving she’s not just a clever parody.
I feel like someone should put up Heartland-style billboards saying “This woman makes public anti-gay rants. She’s schizophrenic. What’s O’Reilly’s excuse?” and fill in names of various other anti-gay commentators.

This thread actually reassures me. I saw a bit of this clip on some political show with no context at all, and I thought she was an elected Republican official of a particularly crazy branch of the party.
I’ve thought that too. Perhaps the real life examples of this should be called “Loughner’s Law”?
