You may recall from a couple of weeks back that AG Mukasey said the JD could not investigate whether CIA officials committed crimes by waterboarding suspects. From the Washington Post:
I see the logic to that, though I am not happy about it. It even leaves open the possibility of other venues of prosecution, unlikely as they are, but that’s for another thread anyway.
But the Justice Department has also concluded that the actions of the the legal eagles who wrote the opinion legitimizing waterboarding ARE subject to investigation. IOW, did they do actual legal research and find support in law for the opinion they produced, or did they just make shit up to order dressed in legalese?
