Well, how interesting! It seems the U.S. Department of Justice has changed its website. Gone are the colorful red, white and blue U.S. flag decorations on the page, replaced by stark black and white. And at the top of the page, is a rather interesting quote:

“The common law is the will of mankind, issuing from the life of the people.”

Catchy, huh? Just one tiny little (too small to be relevant obviously) point – the quote is from C. Wilfred Jenks, who in the 1930’s was a leading proponent of the “international law” movement, which had as its goal to impose a global common law and which backed ‘global workers’ rights.’

Common law is the system of deciding cases that originated in England and which was latter adopted in the U.S.

Common law is based on precedent (legal principles developed in earlier case law) instead of statutory laws. Common law is civil actions one to another where a tort (or wrong) is shown by real damages and to fix blame and determine compensation or restitution.
The U.S. is a common law country. In all states except Louisiana, which is based on Napoleonic code (not much different than common law), the common law of England was adopted as the general law of the state, or varied by statute. Today almost all common law has been enacted into statutes with modern variations by all the states.

In the USA a person can face both statutory law prosecuted by the state or federal government and civil action for the same offence.

Broad areas of the law, such as property, contracts and torts are traditionally part of the common law. Because these areas of the law are mostly within the jurisdiction of the states, state courts are the main source of common law. The area of federal common law is primarily limited to federal issues that have not been addressed by a statute.
In the USA no common law, or statute, can not go against the State or Federal constitution, regardless of what some subcultures desire other wise.

In a general sense common laws are universal rights and wrong tested over the history of man kind, that are larger than any one person, group of people, or a nation of people, in order to have justice and to fix blame where property and people are damaged by each other. Common laws over ride and are superior to customs and cultures. Custom and cultures can be savage and barbaric, where as common laws seek out the better goods.

You can have a custom and or a culture of raiding (robbery), raping, and murders, but common laws forbid this behavior, as it is universally wrong to damage your neighbor no matter what the customs or culture may be, regardless of what any holy books, or God, may say to the contrary.

The will of man kind can be horribly wrong and misguided as history has shown many times over; hence we have common laws for positive, beneficial, guidance to the individual and to society.

Common laws depend on the philosophy of universal rights and wrongs, and the philosophy of justice as compensation and No cruel and unusual punishments, rather than naming and listing each offence as in statutory law.

The classic example would be to “love others as yourself” where as you would not want to be robbed so do not rob others. The statement has untold applications. In addition the punishment must meet the crime and not be over bearing as to be cruel, or too light as to enable wrong doing.

This is law 101, learned in the first week at any first year law class.

It is easy to see Obama does NOT have a clue what he doing with the USA justice department. He is as dumb as a stump and trying to destroy the foundations of the USA with some crap from a Marxists/union hand book. I beginning to doubt he ever went to Harvard and learned something. I bet he failed lunch.

No, you’re missing the point. The fact that the website is in BLACK and WHITE only goes to show that Obama is working on one justice system for blacks and one inferior one for whites. Soon white folk will face a presumption of guilt they will have to conclusively disprove or go to jail, while blacks will be exonerated of major felonies as a form of “reparations” for earlier discrimination. It’s only a matter of time. Wake up, sheeple! Can’t you see what’s happening here?

And I bet that pretty soon he’ll be filling the Justice Department with graduates from unaccredited law schools purely on the basis of their ideological loyalty, something which has never happened before, not ever, nuh-uh.

Yeah, that’s what makes this country great. I know that when I hear about crimes committed against the people of this country, and when the highest level of law enforcement in the land sets out investigate and prosecute those crimes, the first thing on my mind is what color is their website! I’m sure it’s decided at the highest level. Eric Holder dare not make such a life-altering decision on his own. The very fabric of society is at stake. I hope the President makes that determination himself, after consulting with constitutional experts and staying awake into the wee hours examining swatches.

Rubbish. No one knows where that quote came from, except that it’s inscribed on a wall at the DOJ building. Some lawyers attribute it to Jenks, others attribute it to Blackstone; I haven’t seen a good source yet, but it seems very unlikely that Jenks, who published “The Common Law of Mankind” in 1958, is the source of a quote on a wall dating to 1935, when he was only 26.

The website is far more professional-looking than the old one, which looked like Ashcroft’s blog or something.

Common law is not a philosophy of right and wrong nor is it a philosophy of justice as compensation. You are spouting gibberish. Having a common law system, either in Britain or the US, did not prevent slavery, lynching, the idea that forced marital sex cannot be considered rape, etc. It was, in fact, a break from the common law, both in terms of new statutes, constitutional amendments and changing ideas of morality and personhood that led to breaks with the common law in these and other areas and the forging of a new path common law in these subjects. Common law is just an approach - a tool - for trying to make sure that like cases with like facts are treated, well, alike.

That’s a negative. None of the sweeping, vague, and normative generalities you’ve written are covered in the first week as a 1L.

None of the above follows from what you’ve posted. What makes you think Obama is doing anything in particular with the Justice Department, and what specifically is he doing with it?

Everybody knows that black and white is the standard background for all Muslim text. This is just the latest step by the Obama/Panther DOJ towards the imposition of Sharia law on America.

If you read the original \American Spectator article upon which all the uproar about the DOJ website change is based, you find that even the author doesn’t know who’s responsible for the quote. It purportedly dates from the time of FDR, and might be due to Blackwell. Nobody claiming that C. Wilfred Jenks is the author gives a citation, and it’s pretty clear that they’re simply cutting and pasting from each other’s websites.
