What’s the point of suing, Bricker? Can either plaintiff be made whole? What judgment could be rendered that would make a damn bit of difference? What amount of money could compensate for the lost election? Could a miselection be declared and a new one held with a different, untainted electorate, perhaps? You say both Bush and Kerry “should win”, but they should win what? What damages would you propose might be awarded? The winner will still be the winner, with no reason to complain. The loser will still be the loser, with no recourse available after Election Day, SCOTUS “limiting its consideration to the present circumstances” notwithstanding.
The courts are *not * the only, or necessarily best, way to resolve disputes, Counselor. This is just hardball politics. The best way to respond to a smear campaign is to widely publicize the fact that it *is * a smear campaign, along with the proof. Kerry has done so, effectively if not completely, with the Swifties’ lies. Bush cannot, not really, since the heart of the question is not some documents but his failure to serve (and there’s some word for that in the UCMJ, oh, what is it? Hmm), and the topic of his character development and present maturity of judgment is not at all affected here.
