Wells Fargo suit regarding, illegal foreclosure & 6 other laws they broke with me & my home mortgage & chapter 13~ I’m on disability, & they have 20,000 owed to me. 20,000 is all that is owed on my mortgage. Want to pay off (to be done with them) can’t get a correct pay-off. Been waiting 17 months. Meanwhile they are trying to foreclose again~~Insane~I reside Newcastle, California
you need a lawyer - not a message board.
If you have a chapter 13 - you should have a lawyer to help you with this already.
Real-life legal or medical questions belong in IMHO rather than General Questions. Moved.

Correct I need a firm,(Real Estate) I was told . To cover costs. My Chapter 13 Lawyer may be involved with this scam. It is evident someone wants my property (they want me to loose it) Placer County Tax Dept is also in questionAfter reading the instructions, it stated asking for a lawyer can be done herehence why I asked here. Apologies~~~~
Out of curiosity how would they have $ 20,000 owed to you?
And what is the contingency from which the lawyer could derive their fee? If you want the whole $20k to go to the mortgage balance, that leaves nothing for a lawyer.
One imagines that if civil torts were committed by the mortgage holder, punitive damages could be assessed, out of which the lawyer could be paid.
Sorry if you feel you were misled. I don’t think I’ve ever seen an instance of the SDMB being used as a referral service.
Good luck to you in getting it sorted, and if you prevail, please don’t hesitate to come back (after the fact, of course – one piece of legal advice that IS dispensed quite often around here is to be cautious about revealing details of pending legal matters) and tell us how it went down.
Perhaps. I have to admit, though, were I a lawyer (which I am not) I would be a bit suspicious of any claim that the bank, a bankruptcy lawyer and the county tax assessor’s office were all complicit in a conspiracy to defraud someone of their property.
To the OP – Good luck, I truly hope it all works out well for you!
Punitive damages aren’t assessed simply because a tort has been committed. Without getting too technical, it typically requires bad faith or egregious conduct.
As a lawyer, I feel compelled to point out that accusing one’s previous lawyer of defrauding one is not likely to make other lawyers eager to take your case. That goes triple for accusing multiple uninterested parties of conspiring.
