I have some DOS 4.0 and Windows 3.0 disks from a very old computer. The maker of the computer was Leading Technology who also supplied the disks with the computer. Their name is on the disks. Is it legal for me to sell the disks on eBay?
I know that many of you will be temped to tell me that even if it’s legal, don’t bother because they won’t sell. First, I wouldn’t be the only one selling DOS 4.0 and Windows 3.0, second, they’ll be bundled togeather with other software including DOS 6.0 upgrade disks in the orgional box (I know that the other software is legal because it was purchased seperatly). But at any rate, if I can sell them, and they sell, then great. If they don’t sell, it won’t bother me, so please only tell if it’s legal or not. Thanks.
Coincidentally, on Monday on slashdot they had an article about how Microsoft was forcing ebay to take down all Windows auctions because part of their user liscense supposedly stipulates that you cannot resell the software. I dont know if it would hold up in court(IANAL) but you can’t do it on eBay regardless. So I guess that is your answer. I would dig up the link for a cite but I am feeling lazy tonight. If you need it should be easily found by searching the slashdot archives.
